In 2016, the Florida Supreme Court unanimously overturned Clemente Aguirre’s 2006 conviction and death sentence based on new evidence. The state decided to retry Aguirre and seek the death penalty a second time. Josh Dubin acted as one of the lead trial lawyers, and both DRC and Josh Dubin provided trial strategy, jury selection, and demonstrative aid services pro bono. In 2018, during jury selection, prosecutors announced they would not proceed with a retrial based on exculpatory evidence developed by Aguirre's legal team, and Aguirre was freed.
