Wilmington, Del. — DRC congratulates its clients J. Erik Connolly, Nicole Wrigley, Ronald S. Betman, David D. Pope, Michael J. Barrie, Kate Harmon, and Lauren Tortorella of Benesch, Friedlander, Coplan & Aronoff LLP on the successful resolution of its defamation lawsuit against Newsmax on behalf of Smartmatic in Smartmatic USA Corp. et al. v. Newsmax Media Inc. The settlement was reached in the middle of jury selection. By settling this lawsuit, Smartmatic continues to demonstrate its commitment to integrity and truth in safeguarding democracy.

The 2021 defamation lawsuit, filed in Delaware, confronted false claims disseminated by Newsmax regarding Smartmatic's role in the 2020 U.S. presidential election. Smartmatic alleged that Newsmax engaged in the defamation campaign following the presidential election to boost its ratings and draw viewers from Fox News. Smartmatic’s attorney, Erik Connolly, said in a statement, “We are very pleased to have secured the completion of the case against Newsmax. We are now looking forward to our day in court against Fox Corp. and Fox News for their disinformation campaign. Lying to the American people has consequences. Smartmatic will not stop until the perpetrators are held accountable.”

DRC assisted the trial team with jury research, jury selection, demonstrative aids, and trial strategy consulting.
